SmartComps Privacy Policy & End User License Agreement (EULA)

SmartComps (“Smart Comps,” “we,” “our,” or “us”) operates the SmartComps mobile application and related services (“App”).
By downloading, installing, or using the App, you agree to this Privacy Policy and EULA.
1. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use SmartComps for personal or business purposes.
You agree not to:
- Reverse engineer, decompile, or extract source code
- Copy, modify, or distribute the App
- Use the App for unlawful or harmful activity
- Interfere with app functionality or security
- Scrape or extract data in bulk
2. No Account Required
SmartComps does not require user accounts, logins, or profiles.
You can use the App without registration.
3. Description of Service
SmartComps provides commercial real estate tools, including:
- Property comparisons (comps)
- Market insights and analytics
- Investment calculators
- Map-based property exploration
- Aggregated public real estate data
The App is for informational purposes only.
We are not:
- A real estate broker
- An appraiser
- A financial advisor
- A tax advisor
- A legal advisor
You are solely responsible for verifying any information before making decisions.
4. Subscriptions
Some features may require a paid subscription.
- Subscriptions are processed through Apple App Store
- Payment is charged to your Apple ID account
- Subscriptions automatically renew unless canceled
- You can manage or cancel in Apple ID settings
5. Information We Collect
We do not collect personally identifiable information, such as:
- Name
- Email address
- Phone number
- Address
- Payment information
However, we may collect limited non-personal usage data through third-party analytics services, including:
- App usage behavior (screens viewed, interactions)
- Device type and operating system
- App performance and crash logs
This data is aggregated and does not directly identify you.
6. How We Use Information
We use non-personal data to:
- Improve app performance and stability
- Fix bugs and technical issues
- Understand feature usage
- Improve user experience
7. Third-Party Services
We use trusted third-party services, including:
- Google Firebase (Analytics, Crash Reporting, Messaging)
These services may collect and process data according to their own privacy policies. We do not control their systems.
8. Data Sharing
We do not sell personal data.
We do not share personal information with advertisers or third parties.
Analytics data is only used to improve the App.
9. Data Storage
Any data collected by third-party services may be stored on their secure servers.
SmartComps does not operate its own user data storage systems.
10. Children’s Privacy
SmartComps does not knowingly collect personal information from children under the age of 13.
If such data is discovered, it will be removed where applicable.
11. Property Data Disclaimer
Property data may come from public records, third-party providers, or automated systems.
We do not guarantee:
- Accuracy
- Completeness
- Timeliness
- Reliability
Users must independently verify all information.
12. Investment Disclaimer
SmartComps does not provide:
- Investment advice
- Financial advice
- Tax advice
- Legal advice
All investment decisions carry risk, including loss of capital.
13. Intellectual Property
All App content, software, branding, and design are owned by SmartComps or its licensors.
No rights are transferred to users.
14. Third-Party Services & Data
The App may depend on third-party data providers or services.
We are not responsible for:
- Third-party accuracy
- Third-party downtime
- Third-party content
15. Availability
We may modify, suspend, or discontinue the App at any time without notice.
We do not guarantee uninterrupted service.
16. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties including:
- Accuracy
- Fitness for a particular purpose
- Non-infringement
- Reliability
17. Limitation of Liability
To the maximum extent permitted by law, SmartComps is not liable for:
- Investment losses
- Business losses
- Data loss
- Indirect or consequential damages
Total liability shall not exceed $100 USD.
18. Indemnification
You agree to indemnify and hold harmless SmartComps from any claims, damages, or liabilities arising from your use of the App.
19. Termination
We may suspend or terminate access at any time if you violate this Agreement.
Upon termination, your right to use the App ends immediately.
20. Changes to This Agreement
We may update this Policy and EULA at any time.
Continued use of the App means acceptance of updated terms.
21. Governing Law
This Agreement is governed by the laws of the State of California, United States.
